EU Law & Cross-border Matters

Bulgaria is governed by two legal orders at once. We help clients use the European one when it gives them the stronger argument.

Since joining the EU in 2007, and the eurozone in 2026, Bulgaria applies European regulations directly and implements directives through national law. Where the two diverge, EU law wins. For clients that is not an academic point: it can be the argument that unlocks a residence right, defeats an unfair contract term or challenges a decision of a national authority.

Typical matters

  • Free movement. Residence and work for EU citizens in Bulgaria, and the rights of their non-EU family members.
  • Long-term residents. Using EU long-term resident status obtained in Bulgaria to move to another member state, and vice versa.
  • Direct effect. Relying on a directive that Bulgaria has implemented late or incorrectly against a public body.
  • Competition and state aid. Compliance, complaints and defence in proceedings under EU and Bulgarian competition rules.
  • Consumer protection. EU-based consumer rules, which are often decisive in credit and contract disputes.
  • EU procedures. Complaints to the European Commission and references to the Court of Justice through national courts.
  • Residence and work rights of EU citizens and their families
  • Application of EU directives and regulations in Bulgarian proceedings
  • Regulatory compliance with EU requirements
  • Complaints to the European Commission; ECHR applications
  • EU competition law and state aid
  • EU consumer protection rules
  • GDPR and data protection

Questions clients ask

What EU rights do non-EU nationals living in Bulgaria have?

Lawful residents can travel within the Schengen area for short stays, have conditional access to the labour market depending on their permit, and are protected against discrimination. Those who obtain EU long-term resident status after five years acquire additional rights to live and work in other member states.

When can I rely on a directive directly in Bulgaria?

Regulations apply directly. A directive normally needs national implementation, but once the deadline has passed, a sufficiently clear and unconditional provision can be invoked against the state and public bodies even if Bulgaria has not implemented it properly. National courts must also interpret Bulgarian law in line with directives as far as possible.
