Questions clients ask
Who inherits if there is no will?
Children inherit first, in equal shares, and the surviving spouse inherits alongside them with a share equal to that of each child. Without children, the spouse shares the estate with the deceased’s parents or siblings. More distant relatives inherit only if there are no closer heirs.
Can a will leave everything to one person?
Only within limits. Children, the surviving spouse and, where there are no children, parents have a reserved share that a will or lifetime gifts cannot reduce. An heir whose reserved share has been infringed can ask the court to reduce the excessive dispositions.
Can a foreign national inherit property in Bulgaria?
Yes. Foreign heirs can inherit apartments and buildings without restriction. A non-EU heir who inherits agricultural land or forest must, however, transfer it within three years to someone who is legally allowed to own it.
